These terms apply to candidates undertaking a placement through the Professional Internship Program, and to the host companies that receive them.
Terms and Conditions for Candidates
The acceptance of the internship offer will be taken as acceptance of the Terms and Conditions listed below:
1. Fees for Service — Professional Internship Program
STUDY AND WORK provides internship placement for interns who desire to undertake an internship with a nominated host company. These internship placements are used as “Work Experience” and the interns are required to pay the agreed program fee after receiving the confirmed placement offer and prior to starting the internship placement (nil fees apply if you are competing for placement).
Professional Internship Program is designed to provide work experience to assist in developing skills relevant to your field of study and will involve the observation of tasks performed by employees of the host company or the performance of tasks under close supervision of the host company. The internship will be unpaid if the placement benefits the intern more than the host company. The internship will be paid if the placement benefits the host company more than the intern. The internship will be for the duration of 12 weeks, and you can work between 3 to 5 days per week. The program fee is for our service that includes organising placement, internship agreement, training plan, insurance, and providing ongoing support during the period of placement.
2. Internship Placement and Satisfaction Guarantee
STUDY AND WORK guarantees meaningful and study relevant work experience at host company for the period of the internship. This means that if you are not completely satisfied with the work experience offered by host company or your internship gets terminated immaturely, then STUDY AND WORK will find a replacement internship at no extra charge.
3. Internship Placement Process
STUDY AND WORK will do everything possible to place you on your intended start date, however due to the differing nature of every company and their differing time and financial commitments, the exact intended start date may not be available. Upon successful application, STUDY AND WORK will arrange and prepare you for interviews with the prospective host companies. If you are selected, STUDY AND WORK will send you a Confirmation of Placement with an invoice to make necessary payment of program fees (nil fees apply if you are competing for placement). Once the program fees have been paid, STUDY AND WORK will request host company to complete your Internship Agreement and Training Plan and organise your work experience insurance so that you can commence your internship on the agreed date. STUDY AND WORK will try their best to convince the host company to hire you if you are productive during the internship.
4. Our Relationship
STUDY AND WORK is in no way responsible for any damages caused by the intern during the internship placement, regardless of the nature of the damages. The intern accepts full responsibility for their actions. STUDY AND WORK is a facilitator of Professional Internship Program and is not seen as the employer, contracting company or any other mechanism that may constitute the employer/employee relationship with the applicant.
Terms and Conditions for Host Companies
1. Purpose of Agreement
This Agreement sets out the terms under which the Host Company agrees to host a candidate (“Intern”) through the Professional Internship Program facilitated by STUDY AND WORK.
The objective of the program is to provide structured workplace training and enable the Host Company to assess the Intern for potential employment (“Try Before You Hire”).
2. Program Structure
2.1 The internship will typically run for:
- Duration: Up to 12 weeks
- Schedule: 3 to 5 days per week (as mutually agreed)
2.2 The internship is designed as a training and work experience program, not an employment relationship unless otherwise agreed.
2.3 STUDY AND WORK will:
- Source and screen suitable candidates
- Coordinate placement
- Organise a structured Internship Training Plan in accordance with the Fair Work Ombudsman guidelines for internships
- Ensure the internship aligns with vocational training and work experience requirements
- Provide necessary documentation and support throughout the internship
3. Areas of Internship Placement

3.3 STUDY AND WORK will work closely with the Host Company to:
- Understand role requirements
- Match candidates based on skills, qualifications, and career goals
- Ensure alignment between the Intern’s learning objectives and the Host Company’s business needs
4. Host Company Obligations
The Host Company agrees to:
4.1 Provide a structured learning environment relevant to the Intern’s field of study.
4.2 Assign a supervisor/mentor to guide the Intern.
4.3 Provide meaningful tasks that contribute to:
- Skill development
- Industry exposure
- Workplace readiness
4.4 Ensure compliance with:
- Workplace health and safety requirements
- Fair Work guidelines regarding unpaid internships
4.5 Not treat the Intern as a replacement for paid staff.
4.6 Provide feedback and participate in:
- Mid-placement review (approx. week 6)
- Final evaluation (approx. week 12)
5. Intern Status & Remuneration
5.1 The internship is unpaid where it meets Fair Work criteria for vocational placement or training.
5.2 If the Intern becomes productive and contributes commercially, the Host Company agrees to:
- Transition the Intern to a paid arrangement in line with Fair Work requirements.
5.3 The Host Company may offer:
- Casual, part-time, or full-time employment at any stage.
6. Insurance & Liability
6.1 STUDY AND WORK will arrange Work Experience Insurance covering unpaid Interns for the duration of the placement. Paid Interns are covered by the Host Company’s own workers compensation and insurance arrangements.
6.2 The Host Company must:
- Maintain a safe working environment
- Comply with WHS obligations
7. Internship Facilitation Fee
7.1 The standard Internship Facilitation Fee is: AUD $1,100 (no GST) per Unpaid Intern and AUD $2,200 (no GST) per Paid Intern.
7.2 The fee may be paid by:
- The Host Company, or
- The Intern, or
- A partnering education provider (as agreed prior to placement).
7.3 Non-profit organisations are not required to pay the Internship Facilitation Fee. STUDY AND WORK may waive the fee for eligible non-profit or charitable organisations at its discretion to support community initiatives and facilitate student work experience opportunities.
7.4 Promotional or discounted rates may apply where agreed in writing.
8. Employment & Recruitment Fee
8.1 If the Host Company offers employment to the Intern (during or after the internship), the following applies:
- Recruitment Fee: AUD $2,200 (no GST)
- Replacement Guarantee: Up to 6 months (as agreed)
9. Temporary Employment Option
9.1 The Host Company may choose to engage the Intern through STUDY AND WORK payroll:
- Hourly rate: approx. $45/hour (incl. super, taxes, insurance, payroll)
- Weekly invoicing applies
10. Non-Solicitation
10.1 The Host Company agrees not to engage the Intern directly without notifying STUDY AND WORK during the internship period.
10.2 Any direct employment offer must be communicated to STUDY AND WORK.
11. Confidentiality
11.1 Both parties agree to maintain confidentiality of:
- Business information
- Candidate details
- Commercial terms
12. Termination
12.1 Either party may terminate the internship with written notice if:
- The arrangement is not beneficial
- There is misconduct or non-compliance
12.2 STUDY AND WORK will make reasonable efforts to:
- Replace the Intern if required
13. Limitation of Liability
13.1 STUDY AND WORK acts as a facilitator and is not liable for:
- Performance of the Intern
- Business outcomes of the Host Company
14. General
14.1 This Agreement constitutes the entire agreement between the parties.
14.2 Any amendments must be made in writing and signed by both parties.
14.3 This Agreement is governed by the laws of New South Wales, Australia.
